Hosting Terms & Conditions

The rules that govern hosting for sites we build or migrate: what each tier includes, uptime, extra development work, and what happens when the service ends.

1–2. Definitions & subject matter

Provider — Rocksoft sp. z o.o., registered in Ustroń (ul. Katowicka 216, 43-450 Ustroń, Poland), KRS 0000891919, NIP 5482733607, trading as Diligently ("Provider").

1. Definitions

  • Client — the business using hosting services under these Terms.
  • Hosting Plan — one of: Static, CMS Light, CMS Basic, CMS Standard, as described on diligently.pl/hosting.
  • Billing Period — the monthly cycle, counted from the date the Hosting Plan is activated.

2. Subject matter

These Terms govern the hosting of websites built or migrated by the Provider. The Provider does not offer hosting for sites built or maintained by other parties.

These Terms apply both to Clients who use hosting only, and to Clients who also hold a Full-Service Marketing Plan (see Section 10, point 2, on which document takes precedence).

3. Scope of each Hosting Plan

The exact scope of each Hosting Plan is published on diligently.pl/hosting and forms part of the Agreement. In summary:

  • Static (€7/mo) — CDN hosting with automatic SSL, the Client's domain connected, infrastructure-level backups. No content panel — a static site has nothing to edit; content changes are billed hourly (see Section 5).
  • CMS Light (€17/mo) — hosting, SSL and domain connection, content backups with 7-day retention, best-effort restore with no guaranteed turnaround. No active monitoring or guaranteed support response time.
  • CMS Basic (€39/mo) — everything in CMS Light, plus daily backups of content and database with 30-day retention, basic uptime monitoring, and email support with a response within 2 business days. Development hours for new features are billed separately (see Section 5).
  • CMS Standard (€89/mo) — everything in CMS Basic, plus a 24-hour support response SLA, a staging environment to test changes before they go live, hourly backups with 90-day retention, a quarterly review call, and priority queue for paid ad-hoc work. Development hours are still billed separately, but Standard clients go first in the queue.

4. Uptime and service levels

  1. The Provider takes reasonable care to keep hosted sites available, and monitors availability on the CMS Basic and CMS Standard tiers.
  2. The Provider is not liable for outages caused by its infrastructure providers (cloud, CDN, DNS), attacks (e.g. DDoS), pre-announced maintenance, or force majeure.
  3. For the CMS Standard plan, the Provider guarantees 99% uptime per calendar month. If this is not met in a given month, the Client is entitled to that month's fee free of charge — the Client must submit a claim within 14 days of the end of the affected month, with evidence of the downtime. Scheduled maintenance announced in advance, and outages covered by point 2 above, are excluded from the uptime calculation. The other Hosting Plans (Static, CMS Light, CMS Basic) carry no uptime guarantee and operate on a best-effort basis as described in Section 3.

5–6. Development work & migration

5. Development work and extras

Work beyond infrastructure maintenance (new features, larger changes, content changes on the Static plan) is billed separately from the hosting fee, at EUR 50 net per hour, always after the Client approves the quote.

6. Migration and changing plans

  1. Clients on a free first year of hosting under the Webflow Exit offer will be told which Hosting Plan fits their site before the free period ends — with no surprise price jump. A static export typically moves to the Static plan, and an Astro + CMS rebuild typically starts on CMS Light, with the option to move up to CMS Basic or CMS Standard for firmer guarantees.
  2. The Client may change Hosting Plan at any time as their needs change (e.g. more traffic, needing a CMS added). The change takes effect on an agreed date, with the new fee applying from the next Billing Period.

7–8. Domain & ending the service

7. Domain

The domain the Client's site runs on remains the Client's property (or that of an entity they nominate). The Provider is only responsible for the technical connection of the domain to the hosting infrastructure. Domain registration/renewal costs are always billed separately to the Client, whether or not they also hold a Full-Service Marketing Plan (see the Full-Service Marketing Terms, Section 4, point 2).

8. Ending the service and data export

As under the Full-Service Marketing Terms (Section 4, point 3): once hosting ends, on the Client's request made within 30 days of termination, the Provider will provide an export of the CMS content as a ZIP archive by email, or — for large files — a SharePoint link valid for 14 days. These rules apply the same way whether the Client holds hosting only, or hosting alongside a Full-Service Marketing Plan.

9–10. Payments, liability & final provisions

9. Payments

Hosting is billed monthly via Stripe, on the same terms as Section 6 of the Full-Service Marketing Terms (including Stripe's standard retry logic on failed card payments, bank transfer as a fallback, and invoices issued automatically via Stripe) — regardless of whether the Client also holds a Full-Service Marketing Plan. Hosting Plan prices may be indexed annually, with at least one full calendar month's notice before any increase.

10. Liability and final provisions

  1. The Provider's liability to the Client for any failure to perform, or improper performance of, the hosting service is limited to actual loss incurred (excluding lost profit), capped at the hosting fees paid by the Client in the 3 months preceding the event giving rise to the claim. This cap does not apply to loss caused by wilful misconduct.
  2. Where a Client holds both a Full-Service Marketing Plan and hosting, the Full-Service Marketing Terms govern the marketing services, and these Terms govern the hosting service. In case of conflict between the two documents regarding hosting, these Terms prevail.
  3. Sections 10 (confidentiality) and 11 (governing law, disputes, changes to these Terms) of the Full-Service Marketing Terms apply to these Terms accordingly. These Terms are published in English and Polish; in case of discrepancy, the Polish version prevails.
